Judge: Corpse case trial will stay put
Lawyers say 3 men accused of digging up woman's body won't get an impartial jury in Grant County

LANCASTER, Wis. -- In September 2006, they attracted worldwide attention.

More than two years later, the three men accused of trying to dig up the body of a Cassville woman to have sex with her corpse want the case moved out of Grant County.

On Wednesday, Grant County Circuit Court Judge George W. Curry disagreed with attorneys for brothers Alexander and Nicholas Grunke, 23, and Dustin Radke, 22, who sought a change of venue. The case -- for now -- will stay in Grant County. Curry held out the possibility it could move, however.

Attorneys Susan Molini, Suzanne Edwards and Roseann T. Oliveto argued that "inflammatory" publicity over the past two years could affect the trio's ability to receive a fair and impartial trial with only a pool of a "handful" of jurors. Grant County Prosecutor Anthony Pozorski said the recurring publicity was not inflammatory and the "need for a new venue strikes me as too much of a stretch."

The three initially were charged on Sept. 5, 2006, with attempted third-degree sexual assault and attempted misdemeanor theft. The sexual assault charge was dismissed on Sept. 15, 2006, when Curry ruled that Wisconsin had no law that prohibited necrophilia. An appeals court upheld that decision. The Wisconsin Supreme Court overturned that decision in July, on a 5-2 vote.

According to court documents, after reading an obituary and seeing the photo of 20-year-old Laura Tennessen recently interred after a fatal motorcycle accident, the Grunkes and Radke went to the St. Charles Cemetery in Cassville on Sept. 2, 2006, to dig up Tennessen's remains so Nicholas could have sex with the corpse. They fled when a car drove into the cemetery, but they were later apprehended.

On Wednesday, Edwards -- who represents Nicholas Grunke -- opened the hearing with a video that highlighted television and radio reports of the case. Included were comments from state Sen. Dale Schultz, Grant County Sheriff Keith Govier and Grant County Investigator James Kopp.

Edwards claimed the state -- including Pozorski, Govier, Kopp and Schultz -- participated in the "adverse" publicity.

Pozorski said "99 percent" of the publicity was "a matter of reporting about what the state alleges transpired" and not "editorializing."

Curry agreed with the prosecution.

Curry proposed formulating a questionnaire for the jury pool.

"If 50 percent say they can't be fair, then we've got a problem, and we'll go somewhere else," he said.

The hearing concluded with an arraignment where the trio pleaded not guilty to all of the charges -- attempted criminal damage to a cemetery, attempted misdemeanor theft and attempted third-degree sexual assault. Curry set a motion hearing for 9 a.m. on Jan. 6. No trial date has been set.
